This Privacy Policy describes the way that we collect and use your data. By using the Modelar App, you are agreeing to the collection and use of your data through the use of the Modelar App, the Modelar.ai website, and in correspondence with us, in accordance with this policy.
Definitions
For the purposes of this Privacy Policy:
- Application (or “App”) refers to the Modelar mobile application made by Modelar Technologies, which is the business name of Persistent Ventures Inc., a company based in Canada (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement).
- You (referred to also as “Your” in this Agreement) means the individual, company or legal entity accessing or using the Modelar App, or the company, or other legal entity on behalf of which they are accessing or using the App, as applicable.
- Device refers to any device that can run the App, such as a cellphone or digital tablet.
- Content refers to any spatial data, notes, images, sounds, videos or other data generated or produced through your use of the App.
- Personal Data is any information that relates to an identified or identifiable individual. Usage Data refers to descriptive data collected automatically through as a result of use of the App.
Data Collection and Use
Types of Data Collected
Content
You retain the rights to any Content you collect or generate with the App. We do not automatically collect your Content. It remains resident on your Device, unless you have explicitly directed us to collect it or transmit it to a third-party service.
We do automatically collect data that describes your Content including, but not limited to, the length of time taken to collect the Content, the space required to store your Content and the number of separate sets of Content you have collected. We do not link this information to your identity.
The App collects geospatial Location data, which it uses to georeference your content. We do not collect this data, or link it to your identity.
Usage data
We automatically collect some Usage Data while you are using the App. This data includes the App features that were used, some device parameters such as the device’s Internet Protocol address (“ IP address”), the version of the App that was used and other diagnostic information. This information is used solely to analyze and improve the App’s performance, guide the development of new features, and improve existing features. We do not link this data to any Personal Data or to your identity. We do collect any identifying information from your device, nor do we access the Apple IDFA.
Crash data
We may collect some Crash Data when the App has errors or crashes. This data is used to diagnose and fix problems with the App, improve the App’s performance and improve the quality of the App’s and the underlying source code. This data is not linked to your identity.
Data submitted to us
Should you contact us, request support, or request information from us, we will retain your contact data and any associated Content or Personal Data that you submit to us in order to satisfy your request.
We may also use your contact data from time to time to contact you and provide you with information, unless you request that we do not.
Data Retention
We will retain any collected Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use all data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
Data Sharing
We will not share, sell or disclose your data to anyone outside the company, with the following exceptions:
- We may share data internally between the Company’s operating sites.
- We may retain a third-party service, such as MixPanel, to collect and analyze Usage Data on our behalf.
- You may request that we share data, either directly, or as part your use of an external, third-party service. In this case, we share only the minimum amount of information required to enable your use of the third-party service.
- We may be required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
Changes to this policy
We may update this privacy policy from time to time. We will notify you of any material changes, either through a notification in the Modelar App, or by email. We will let also update the “Last updated” date at the top of this Agreement.
